Agreement to Terms

By accessing or using the Sacred Sky Strategy website (sacredskystrategy.com and sacredskystrategy.manus.space), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Use License

Permission is granted to temporarily download one copy of any downloadable materials on Sacred Sky Strategy's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

You may not modify or copy the materials. You may not use the materials for any commercial purpose or for any public display. You may not attempt to reverse engineer any software contained on Sacred Sky Strategy's website. You may not remove any copyright or other proprietary notations from the materials. You may not transfer the materials to another person or mirror the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Sacred Sky Strategy at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Services

Sacred Sky Strategy provides email marketing strategy, consulting, and management services for direct-to-consumer wellness brands. All services are subject to the terms outlined in individual service agreements or statements of work.

Service Engagement

When you engage Sacred Sky Strategy for services, you agree to provide accurate information about your business, marketing goals, and current email marketing setup. You are responsible for providing timely feedback, approvals, and access to necessary platforms (such as Klaviyo, Shopify, or other marketing tools) as outlined in your service agreement.

Payment Terms

Payment terms are specified in individual service agreements. Generally, project-based services require 50% payment upfront and 50% upon completion. Monthly retainer services are billed at the beginning of each month. All payments are due within 7 days of invoice date unless otherwise specified.

Late payments may result in suspension of services and may incur a late fee of 1.5% per month on the outstanding balance. If payment is more than 30 days overdue, Sacred Sky Strategy reserves the right to terminate the service agreement and pursue collection of outstanding amounts.

Refund Policy

Due to the nature of consulting and strategy services, all payments are non-refundable once work has commenced. For project-based services, if you choose to cancel before work begins, you will receive a full refund minus any setup or administrative fees already incurred.

For monthly retainer services, you may cancel at any time with 30 days written notice. You will be responsible for payment through the end of the notice period. No refunds will be provided for partial months of service.

Intellectual Property

The content, design, graphics, and other materials on this website are owned by or licensed to Sacred Sky Strategy and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without express written permission from Sacred Sky Strategy.

Client Work Product

For services provided, Sacred Sky Strategy retains ownership of all processes, methodologies, templates, and frameworks used in delivering services. Upon full payment, clients receive a license to use the specific deliverables created for their business (such as email copy, flow designs, and strategy documents) for their own business purposes.

Clients may not resell, redistribute, or claim ownership of Sacred Sky Strategy's proprietary methodologies or frameworks. Any templates, audits, or strategic documents provided remain the intellectual property of Sacred Sky Strategy, with clients receiving a non-exclusive, non-transferable license to use them for their business.

Confidentiality

Sacred Sky Strategy agrees to maintain the confidentiality of all client information, including business strategies, customer data, revenue figures, and proprietary processes. Client information will not be shared with third parties except as necessary to provide services (such as with email service providers) or as required by law.

Clients agree to maintain the confidentiality of any proprietary methodologies, frameworks, templates, or strategic insights shared by Sacred Sky Strategy during the course of service delivery.

Disclaimer

The materials on Sacred Sky Strategy's website are provided on an "as is" basis. Sacred Sky Strategy makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Sacred Sky Strategy does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Results Disclaimer

While Sacred Sky Strategy strives to deliver exceptional results for clients, specific outcomes (such as revenue increases, conversion rate improvements, or subscriber growth) cannot be guaranteed. Results depend on many factors outside of Sacred Sky Strategy's control, including product quality, pricing, market conditions, brand reputation, website performance, and client implementation of recommendations.

Any case studies, testimonials, or examples of results shared on this website or in marketing materials represent specific client experiences and should not be interpreted as a guarantee of similar results for your business.

Limitations of Liability

In no event shall Sacred Sky Strategy or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Sacred Sky Strategy's website, even if Sacred Sky Strategy or a Sacred Sky Strategy authorized representative has been notified orally or in writing of the possibility of such damage.

In jurisdictions where such limitations are not allowed, Sacred Sky Strategy's liability shall be limited to the maximum extent permitted by law.

The maximum aggregate liability of Sacred Sky Strategy for any claims arising out of or related to services provided shall not exceed the total amount paid by the client for services in the 12 months preceding the claim.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Colorado, United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Any disputes arising from these Terms of Service or from services provided by Sacred Sky Strategy shall be resolved through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association. Each party shall bear their own costs of arbitration.
